These Terms of Service ("Terms") govern your access to and use of themockinterview.ai (the "Service") provided by Valor Education Inc. ("we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

themockinterview.ai is an AI-powered mock interview preparation tool that:

• Generates personalized interview questions based on job descriptions and resumes
• Provides AI-generated feedback on interview responses
• Offers different interviewer personas and question regeneration (Pro features)

2. Eligibility

You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement.

3. Account Registration

3.1 Account Creation

You must create an account to use the Service. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your password
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

3.2 Account Termination

We reserve the right to suspend or terminate your account at any time for:

• Violation of these Terms
• Fraudulent or illegal activity
• Abuse of the Service or other users
• Non-payment

You may delete your account at any time through account settings or by contacting questions@themockinterview.ai.

4. Subscription Plans and Pricing

4.1 Free Tier

• 1 session per month
• 3 questions per session
• Generic interviewer persona
• Limited features

4.2 Pro Subscription ($10/month)

• Unlimited sessions
• 10 questions per session
• All interviewer personas
• Question regeneration (80/month limit)
• Full answer history
• Cancellable anytime

4.3 Single-Session Credits ($3 each)

• One-time purchase
• Unlocks Pro features for one session
• Does not expire
• Non-transferable

4.4 Price Changes

We reserve the right to modify pricing with 30 days' notice to existing subscribers. Continued use after price changes constitutes acceptance.

5. Payment Terms

5.1 Payment Processing

All payments are processed securely through Stripe. By providing payment information, you authorize us to charge the applicable fees.

5.2 Billing

• Pro Subscriptions: Billed monthly on the date you subscribe
• Credits: Charged immediately upon purchase
• Auto-Renewal: Pro subscriptions auto-renew unless cancelled

5.3 Failed Payments

If payment fails:

• We will attempt to charge your payment method multiple times
• Your account may be downgraded to Free tier
• Access to Pro features will be restricted

6. Refund Policy

6.1 Single-Session Credits

• Full refund: Within 14 days if credit is unused
• No refund: Once questions are generated (service has been delivered)

6.2 Pro Subscriptions

• Cancellation: You may cancel anytime; service continues until end of billing period
• No partial refunds: We do not provide refunds for partial months
• Exception: Technical issues on our end preventing Service use

6.3 Refund Requests

To request a refund, contact questions@themockinterview.ai within the applicable refund period. Include:

• Account email
• Purchase date and amount
• Reason for refund request

Refunds are processed within 5-10 business days to your original payment method.

6.4 Chargebacks

Initiating a chargeback without contacting us first may result in immediate account termination.

7. Acceptable Use

You agree NOT to:

• Use the Service for any illegal purpose
• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Transmit malware, viruses, or harmful code
• Attempt to gain unauthorized access to the Service
• Reverse engineer, decompile, or disassemble the Service
• Use automated systems (bots, scrapers) without permission
• Resell or redistribute the Service
• Harass, abuse, or harm other users
• Share your account with others

Violation may result in immediate account termination without refund.

8. Content and Intellectual Property

8.1 Your Content

You retain ownership of content you upload (resumes, job descriptions, responses). By using the Service, you grant us a limited license to:

• Process your content to provide the Service
• Generate interview questions and feedback
• Store your content in our systems

We will not share your content publicly or use it for purposes other than providing the Service.

8.2 Our Content

The Service, including all software, designs, text, graphics, and AI-generated content, is owned by Valor Education Inc. and protected by copyright, trademark, and other intellectual property laws.

8.3 AI-Generated Content

Interview questions and feedback generated by the Service are provided "as-is." While we strive for quality:

• AI-generated content may contain errors or inaccuracies
• Content is not a substitute for professional career advice
• We do not guarantee the quality or accuracy of AI outputs

9. Third-Party Services

The Service integrates with third-party services:

• Firebase/Google Cloud: Data storage and authentication
• Stripe: Payment processing
• OpenAI: AI question generation

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party service failures or changes.

10. Disclaimers and Limitations of Liability

10.1 No Employment Guarantees

10.2 Service "As-Is"

THE SERVICE IS PROVIDED "AS-IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Uninterrupted or error-free operation

10.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

VALOR EDUCATION INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING:

• Lost profits or opportunities
• Lost data
• Business interruption
• Personal injury
• Emotional distress

ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 CAD, WHICHEVER IS GREATER.

10.4 Jurisdictional Limitations

Some jurisdictions do not allow limitation of implied warranties or liability for incidental damages. In such jurisdictions, our liability is limited to the extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Valor Education Inc., its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of others
• Your content uploaded to the Service

12. Privacy

Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy at themockinterview.ai/privacy.

13. Modifications to the Service

We reserve the right to:

• Modify, suspend, or discontinue any aspect of the Service
• Change features, functionality, or availability
• Impose limits on features or storage

We will provide reasonable notice of material changes, but are not liable for any modifications, suspensions, or discontinuations.

14. Modifications to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last Updated" date.

Material changes: We will notify you via email or prominent notice on the Service at least 30 days before the effective date.

Continued use of the Service after changes take effect constitutes acceptance of the new Terms.

15. Termination

15.1 By You

You may terminate your account at any time by:

• Deleting your account through account settings
• Contacting questions@themockinterview.ai

15.2 By Us

We may terminate or suspend your account immediately, without notice, for:

• Violation of these Terms
• Fraudulent activity
• Non-payment
• Legal requirements
• Service discontinuation

15.3 Effect of Termination

Upon termination:

• Your right to use the Service ends immediately
• We may delete your account and data (subject to retention requirements)
• Outstanding fees remain due
• Sections that should survive (liability, indemnification, etc.) remain in effect

16. Dispute Resolution

16.1 Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

16.2 Jurisdiction

Any disputes arising from these Terms or the Service shall be resolved exclusively in the courts of Ontario, Canada. You consent to the personal jurisdiction of these courts.

16.3 Informal Resolution

Before filing any legal claim, you agree to first contact us at questions@themockinterview.ai to attempt informal resolution. We will attempt to resolve disputes in good faith within 30 days.

16.4 Class Action Waiver

You agree to resolve disputes with us on an individual basis only. You waive any right to participate in class actions, class arbitrations, or representative actions.

17. General Provisions

17.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Valor Education Inc. regarding the Service.

17.2 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full effect.

17.3 No Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

17.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.

17.5 Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control (natural disasters, war, strikes, internet failures, etc.).

17.6 Language

These Terms are drafted in English. Any translations are provided for convenience only. In case of conflict, the English version prevails.
